Welcome to Amazing Meds. By accessing or using our website and telehealth platform, you agree to comply with and be bound by the following terms and conditions. Please review them carefully. If you do not agree with any of these terms, you should not use our website or services.
1. Acceptance of Agreement
1.1 You agree to the terms and conditions outlined in this Terms of Use Agreement (“Agreement”) with respect to our website (the “Site”) and our online services. This Agreement constitutes the entire and only agreement between us and you and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the Site, the content, products, or services provided by or through the Site.
2. Telemedicine Informed Consent
2.1 By using our services, you acknowledge and agree that telemedicine involves the delivery of healthcare services using electronic communications between a healthcare provider and a patient who are not in the same physical location. 2.2 You understand that while telemedicine provides significant benefits, there are potential risks, including technical interruptions and the inability to conduct an in-person physical examination. By proceeding, you consent to receive healthcare services via these technologies.
3. Geographic Limitations & Eligibility (Critical Disclosure)
3.1 Amazing Meds provides services only to individuals located in the states where we are licensed to operate. 3.2 Currently, our services are available in 45 U.S. states and the District of Columbia. 3.3 Restricted States: We DO NOT provide services to residents of, or individuals physically located in: Alabama (AL), Alaska (AK), Arkansas (AR), Louisiana (LA), and Mississippi (MS). 3.4 You represent and warrant that you are physically located in a state we serve at the time of your consultation.
4. Scope of Telehealth Services
4.1 Amazing Meds provides specialized clinical evaluations for hormone replacement therapy (HRT) and peptide therapy. 4.2 Our services are NOT a substitute for primary care or emergency medical services. If you are experiencing a medical emergency, you must call 911 or visit the nearest emergency room immediately.
5. Prescribing Policy & Clinical Evaluation
5.1 All prescriptions are issued at the sole discretion of the licensed healthcare provider following a comprehensive medical evaluation and required diagnostic testing. 5.2 A consultation does not guarantee that a prescription will be issued. 5.3 We do not prescribe controlled substances for off-label uses such as anti-aging, athletic performance, or cosmetic purposes without documented medical necessity.
6. HIPAA, Privacy, and PHI Handling
6.1 Your Protected Health Information (PHI) is handled in accordance with the Health Insurance Portability and Accountability Act (HIPAA). 6.2 By using our Site, you agree to the collection, use, and disclosure of your health data as outlined in our HIPAA Notice of Privacy Practices, which is incorporated into these Terms by reference. 7. Product Descriptions, Compounding, and Pricing
7.1 Amazing Meds attempts to be as accurate as possible. However, we do not warrant that product descriptions are error-free. 7.2 Compounded medications are prepared by licensed 503A compounding pharmacies. Compounded drugs are not FDA-approved and have not been evaluated by the FDA for safety, efficacy, or quality. 7.3 All prices displayed are subject to change without notice.
8. Consultation Fees, Refunds, and Cancellations
8.1 Consultation Fees: Fees for medical evaluations are for the provider’s time and clinical assessment. These fees are non-refundable once the consultation has taken place, regardless of whether a prescription is issued. 8.2 Cancellations: Appointments cancelled with less than 24 hours’ notice may be subject to a cancellation fee. 8.3 Medications: Due to federal and state regulations, prescription medications cannot be returned or refunded once they have been dispensed by the pharmacy.
9. Intellectual Property Rights
9.1 All content included on the Site, such as text, graphics, logos, images, and data compilations, is the property of Amazing Meds and protected by international copyright laws.
10. User Accounts
10.1 You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.
11. Limitation of Liability & Indemnification
11.1 Amazing Meds will not be liable for any damages arising from the use of the Site or from any information, products, or services made available to you through the Site. 11.2 You agree to indemnify and hold harmless Amazing Meds from and against all losses, expenses, and damages resulting from any violation of this Agreement by you.
12. Governing Law
12.1 This Agreement shall be governed by and construed in accordance with the laws of the state of Colorado, without regard to its conflict of law principles.
13. SMS and Mobile Messaging Terms
13.1 Program Name: Amazing Meds Patient Alerts.
13.2 Description: By opting into our messaging service, you agree to receive recurring automated and manual text messages (SMS/MMS) regarding your clinical care, appointment reminders, prescription updates, and health coaching related to your hormone or peptide therapy.
13.3 Message and Data Rates: Message and data rates may apply for any messages sent to you from us and to us from you.
13.4 Message Frequency: This is a recurring message program; frequency varies based on your stage of treatment and interaction with the platform.
